LEGAL SEPARATION OR DIVORCE OF MARRIED MEMBERS
In the event of the divorce or separation of spouses having membership privileges in either a Gold, Platinum or Diamond membership tier, the membership, including all of its rights and benefits, will vest solely in the spouse awarded the membership by an agreement of separation or a decree of divorce.
Until the award of the membership and written notice thereof is provided to BVCL, both spouses will be jointly and severally liable for all dues and charges and both may continue to enjoy membership privileges so long as such amounts are timely paid.
BVCL reserves the right to not transfer the membership to either spouse if BVCL, in its discretion, is unable to determine the person who is lawfully entitled to receive the membership. When ownership of the membership has been determined, written notice thereof and the relevant documentation shall be promptly delivered to BVCL.
The disposition of the membership must be determined within one year after a separation or, in the case of a divorce, within such one-year period, the title to the membership must be addressed. In the decree of divorce, BVCL has the right to suspend membership privileges until ownership of the membership has been determined and BVCL has received written notice thereof and the appropriate documentation.
BVCL shall also have the right in either such case to deem the membership resigned in its discretion.
Following a separation or divorce and award of the membership as contemplated hereby, the spouse awarded the membership shall have the right to determine which Immediate Family Members will be permitted to use BVCL services under the membership.
BVCL will not become involved in any domestic or other dispute concerning ownership or issuance of a membership and does not have any liability or responsibility for resolution of such disputes. If BVCL is uncertain as to who should receive the refund, if any, associated with a refundable membership, BVCL in its discretion may file an interpleader action or similar type action and thereby deposit the refund amount into the registry of a court of competent jurisdiction for the court to determine who is entitled to the refund without recourse to BVCL.
BVCL shall be entitled to a reimbursement of reasonable attorneys’ fees and costs from the Member in question for filing such interpleader action. BVCL reserves the right to petition the divorce court to determine who is entitled to the refund, if any, once the refund becomes payable.
MEMBERSHIP TRANSFER UPON DEATH
In the unfortunate event of the death of the primary member having membership privileges, the membership, including all of its rights and benefits, will vest in the spouse or an active adult child listed on the account as per written on the decedent’s will. Until the award of the membership and written notice thereof is provided to BVCL, BVCL will freeze the account for up to three (3) months. Legacy transfer will be counted under this circumstance.
BVCL reserves the right to not transfer the membership to active family members if BVCL, in its discretion, is unable to determine the person who is lawfully entitled to receive the membership. When ownership of the membership has been determined, written notice thereof and the relevant documentation shall be promptly delivered to BVCL.
The disposition of the membership must be determined within three (3) months after the death of the primary member, within such three month period the title to the membership must be addressed.
